1) Overview & Acceptance

This website is operated by me. By visiting www.mybioduct.com or purchasing/booking through the site (the “Site”), you agree to these Terms & Conditions (“Terms”). If you do not agree, please do not use the Site.

I may update these Terms at any time by posting a new version here. Your continued use of the Site means you accept the changes.

2) Eligibility

By using the Site, you confirm you are at least the age of majority in your state/country. If you allow a minor dependent to use the Site, you take responsibility for their use.

3) Services & Scope

I offer coaching/consulting/training and, where applicable, psychotherapy/tele-health services.

Coaching/consulting/training are not medical, psychological, legal, or financial advice and are not a substitute for therapy or medical care.
Therapy/tele-health is available only to clients located in states where I’m licensed at the time of the session (currently PA, NJ, SC for therapy; coaching/consulting has no geographic limitation). Crisis care is not provided through this Site.

4) Online Purchases, Scheduling & Billing

You agree to provide current, complete, and accurate information for all purchases and bookings.
I reserve the right to refuse, limit, or cancel an order/booking (e.g., suspected fraud or reselling). If I change or cancel an order, I’ll try to notify you using the email/phone you provided.
Prices may change at any time. Posted prices do not include taxes/fees unless noted.

Cancellations, Rescheduling & Refunds

Unless otherwise stated in your service agreement or checkout page, rescheduling requires at least 24 hours’ notice.
Missed appointments or late cancellations may be charged in full.
Coaching/consulting packages may include non-refundable deposits and use-by windows; details appear at checkout or in your service agreement.
No refunds for services already performed.

5) Insurance & Private Pay (Therapy)

If you choose private pay, no claim is submitted to an insurer. If you later request a superbill, note it will include diagnosis/CPT codes and may reduce privacy.
Reimbursement is not guaranteed; check your plan. I am not responsible for insurance denials or benefit determinations.

6) Site Content, Accuracy & Changes

Information on the Site is for general informational purposes and may not be complete, current, or tailored to your situation. I may modify or discontinue any part of the Site or services at any time without notice.

7) Acceptable Use

You agree not to:

Use the Site for unlawful purposes or to violate any law.
Upload or transmit malware, scraping, or disruptive code.
Infringe intellectual-property or privacy rights.
Harass, defame, or discriminate against others.
Attempt to bypass security features or access non-public areas.

I may suspend or terminate access for violations.

8) User Submissions & Feedback

If you send ideas, comments, or materials, you grant me a non-exclusive, worldwide, royalty-free license to use and share them for Site and service improvement without obligation to you. Do not send protected health information (PHI) through standard Site forms or chat.

9) Privacy, Cookies & PHI

Your use of the Site is governed by my [Privacy Policy].

The Site runs on Wix; do not submit PHI through Wix forms or chat. Ask for a secure channel if clinical information is needed.
The Site may use cookies and analytics. You can manage non-essential cookies via the cookie banner.

10) Third-Party Tools & Links

The Site may provide access to third-party tools, schedulers, payment processors, or external websites. These are provided “as is” without warranties. I am not responsible for third-party content, policies, security, or availability. Review their terms before use.

11) Intellectual Property

All content on the Site—including text, branding, graphics, and downloadable materials—is my intellectual property or used with permission. You may not reproduce, sell, or exploit Site content or access without my written consent.

12) No Professional Guarantees

I do not guarantee specific outcomes or results. Coaching/consulting outcomes depend on multiple factors including your engagement, context, and implementation. Any testimonials represent individual experiences and are not a promise of results.

13) Disclaimer of Warranties

The Site and services are provided “as is” and “as available.” I do not guarantee uninterrupted or error-free operation, or that results will meet your expectations.

14) Limitation of Liability

To the fullest extent permitted by law, I am not liable for indirect, incidental, special, consequential, or punitive damages; lost profits; data loss; or business interruption arising from your use of the Site or services. Where liability cannot be excluded, it is limited to the amount you paid for the relevant service in the 3 months before the claim.

15) Indemnification

You agree to indemnify and hold me harmless from claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Site, or your violation of laws or third-party rights.

16) Termination

I may suspend or terminate access to the Site or services at any time, including for policy violations. Your obligations that by nature should survive termination (payments due, IP, disclaimers, limitations of liability, indemnity) will continue.

17) Governing Law & Venue

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts.

18) Changes to These Terms

You can always view the latest version on this page. I may update these Terms at any time by posting a new version. Continued use of the Site after changes means you accept the updated Terms.
